Terms of Use
Introduction
The services (hereinafter referred to as “the Services”) provided on All About Tama: The Official Website for Tokyo’s Tama Region” (hereinafter referred to as“the Website”), operated by the DESTINATION TOKYO TAMA Office (hereinafter referred to as “the Operator”), are governed by these Terms of Use (hereinafter referred to as “the Terms”).
By using the Services, users (hereinafter referred to as “Users”) are deemed to have agreed to all provisions of the Terms.
If you do not agree to the Terms, please refrain from using the Services. Please note that the Terms may be changed without prior notice. When using the Services, please refer to the most recent version posted on the Website.
1. Use of the Services
(a) Restrictions on Use
The Operator reserves the right to establish rules concerning the use of the Services and to impose restrictions. The Operator may revise these rules at any time without prior notice to Users. If the Operator suffers damages due to a User’s actions, the Operator may claim compensation for such damages from the User.
(b) Required Equipment and Costs
To use the Services, Users must access the Website. Users are responsible for procuring, installing, and operating the necessary equipment, software, and communication means at their own cost. The Operator has no involvement in the preparation or method of access to the Website.
(c) Notices and Communication
When the Operator deems it necessary to contact a User, it will do so by email, based on the information provided by the User. When a User needs to contact the Operator, they must do so via the designated email address: information@tama.metro.tokyo.lg.jp. The Operator will not accept notifications or inquiries via any other means.
2. Intellectual Property Rights
All copyrights, trademarks, design rights, and other intellectual property rights in the photographs, logos, images, videos, text, music, and other content posted on the Website belong to the Operator, unless otherwise indicated. Where content belongs to a third party, rights are held by that party.
Except where expressly permitted by the Operator, any reproduction, reuse, reprinting, electronic processing, transmission, distribution, transfer, lending, secondary use, or any similar act involving the content of the Website is strictly prohibited.
3. Disclaimers
The Operator does not guarantee the completeness, accuracy, usefulness, or non-infringement of third-party rights regarding the information (including text, videos, and software) provided through the Website. The Operator shall not be liable for any troubles or damages arising from the use of the Website, including those related to software, hardware, or communication lines.
If the Operator determines that a User has engaged in acts that violate laws, promote or lead to criminal behavior, contravene public order and morals, infringe upon the rightsor privacy of others, use fictitious or third-party email addresses, attempt to damage the security or systems of the Services, or otherwise commit improper acts, the Operator may, without prior notice, prohibit the User from using the Services, and shall bear no responsibility for such prohibition. The Operator is not liable for damages resulting from such acts committed by third parties.
In the event of fire, power outage, earthquake, other natural disaster, war, riot, disturbance, labor dispute, governmental order, access exceeding anticipated volumes, or deterioration/failure of communication environments, the Operator may, without prior notice or consent of the User, suspend, change, or terminate the Services. The same applies when temporary suspension is deemed necessary for operational or technical reasons.
The Operator shall not be liable to Users or third parties for any delay, change, suspension, stoppage, or termination of the Services, except where caused by the Operator’s willful misconduct or gross negligence. If the Operator receives claims or demands for damages from third parties in connection with the Services, Users must cooperate to the extent necessary to resolve such matters.
4. Violations of the Terms
If a User discovers any acts that violate or may violate the Terms, they must promptly contact the Website’s Operator.
5. Governing Law and Jurisdiction
All matters, including disputes related to the Website, shall be governed by the laws of Japan. The Tokyo District Court of Japan shall have exclusive jurisdiction as the court of first instance.
